DRIVER HIRING SERVICE TERMS AND CONDITIONS
This Service Terms and Conditions is entered into between, Client (the individual registering and accepting this terms and conditions online), and Suvidha Facility Private Limited, a private limited company incorporated under the laws of Nepal, having its registered office at Post Box No. 4930, Krishna Galli-03, Lalitpur (hereinafter referred to as the “Service Provider”).
The purpose is to define the terms and conditions under which the Service Provider shall introduce and facilitate the hiring of a driver (“Staff”) to the Client on a one time hiring fee basis only.
2.1 The Service Provider shall: Identify, screen, and introduce a suitable driver based on the Client’s stated requirements. Verify identity documents of the Staff to the extent reasonably possible. Facilitate the initial interview and selection process only.
2.2 The Service Provider does not: Employ, deploy, supervise, control, or manage the Staff. Determine wages, benefits, working hours, leave, or duties. Maintain payroll, attendance, or performance records of the Staff.
2.3 The Service Provider’s role is strictly limited to recruitment and introduction services, ensuring no principal agent or employer-employee relationship exists.
3.1 The Client agrees to pay the Service Provider a one time, non refundable hiring fee of NPR. 10,000/-.
3.2 The hiring fee is payable prior to or immediately upon confirmation of the Staff and is solely for recruitment and introduction services.
3.3 No monthly service charge, commission, or recurring fee shall be applicable under these terms and conditions.
4.1 Upon selection, including the trial period, the Staff shall be deemed to be directly and exclusively employed by the Client.
4.2 These terms and conditions does not create: Any employer-employee relationship between the Service Provider and the Staff; or Any agency, partnership, joint venture, or fiduciary relationship between the Parties.
4.3 The Client shall issue all instructions, supervise work, and exercise disciplinary authority over the Staff.
The Client shall be solely and fully responsible for: Payment of salary, wages, overtime, festival allowance, gratuity, insurance, medical expenses, and any other compensation payable to the Staff. Direct payment of wages to the Staff during the trial period and thereafter without involvement of the Service Provider.
6.1 The Service Provider shall not be liable, directly or indirectly, for any act, omission, misconduct, negligence, theft, injury, accident, illness, abuse, harassment, death, or criminal act involving the Staff or shall not be responsible for any claim, demand, penalty, audit objection, or legal proceeding initiated by any authority or third party arising out of the Client.
6.2 The Service Provider shall not be responsible for any claim, demand, penalty, audit objection, or legal proceeding initiated by any authority or third party arising out of the Client’s engagement of the Staff.
6.3 The Client agrees to indemnify, defend, and hold harmless the Service Provider, its directors, officers, and employees from any losses, damages, fines, claims, or expenses (including legal fees) arising from the employment or engagement of the Staff.
7.1 A three (3) day trial period shall apply from the Staff’s first working day.
7.2 During the trial period: The Staff shall be deemed directly employed by the Client. All wages for the trial period shall be paid directly by the Client to the Staff. The Service Provider shall have no financial or managerial obligation.
7.3 A one-time replacement may be provided within fifteen (15) days from the Staff’s joining date, subject to availability and internal policy.
7.4 Replacement shall not be applicable in cases of misconduct by the Client, change in job requirements, workplace issues, non-payment, or breach of these terms and conditions.
7.5 No cash refund shall be made under any circumstances.
8.1 These terms and conditions shall automatically terminate upon: Completion of successful placement; and Payment of the full hiring fee.
Both Parties agree to keep confidential any personal or sensitive information exchanged under these terms and conditions, except where disclosure is required by law.
These terms and conditions shall be governed by and construed in accordance with the laws of Nepal. The courts of Kathmandu, Nepal shall have exclusive jurisdiction.
These terms and conditions constitutes the entire understanding between the Parties and supersedes all prior discussions or representations, whether oral or written.
Any amendment to these terms and conditions shall be valid only if made in writing and signed by both Parties.
By registering on the website and selecting “I Agree” (or similar action), the Client acknowledges that they have read, understood, and agreed to be legally bound by the terms and conditions.
